"Two Parts of the Landscape of Family in America": Maintaining both Spousal and Domestic Partner Employee Benefits for Both Same-Sex and Different-Sex Couples

Nancy Polikoff, American University Washington College of Law

Abstract

An essay is presented on spousal and domestic partner employee benefits in the U.S. as of November 2012, focusing on an examination of differences between the benefits afforded to same-sex and opposite-sex couples. In Arizona, an administrative regulation was passed in 2008 to provide extended health benefits to the domestic partners of Arizona state employees. Several legal cases are addressed, including the U.S. District Court for the District of Arizona case Collins v. Brewer.
