Abstract
[quote] American University Associate Law Professor Jennifer Daskal also spoke at the hearing, and suggested a law that would require U.S. courts, when considering warrants for overseas data, to account for things such as the location of the crime and its victim. Such a law should also require notifying foreign governments when data is sought on one of its citizens, Daskal said.
“These types of nuanced solutions cannot be implemented by the courts,” Daskal told the subcommittee. “Only Congress can act in a way that appropriately takes into account the full range of security, privacy, economic and diplomatic concerns.”
